OVERVIEW Welcome to Tempest & the Rabbit! The terms "we", "us" and "our" refer to Tempest & the Rabbit. Tempest & the Rabbit operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the "Services"). Tempest & the Rabbit is powered by Shopify, which enables us to provide the Services to you.
The below terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms") describe your rights and responsibilities when you use the Services.
Please read these Terms of Service carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability.
By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or Privacy Policy, you should not use or access our Services.
SECTION 1 - ACCESS AND ACCOUNT By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, and you have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase or manage.
To use the Services, including accessing or browsing our online store or purchasing any of the products or services we offer, you may be asked to provide certain information, such as your email address, billing, payment, and shipping information. You represent and warrant that all the information you provide is correct, current and complete and that you have all rights necessary to provide this information.
You are solely responsible for maintaining the security of your account credentials and for all of your account activity. You may not transfer, sell, assign, or license your account to any other person.
SECTION 2 - OUR PRODUCTS Tempest & the Rabbit offers The Curiouser, a physical subscription delivering hand-designed printed booklets exploring consciousness research, anomalous experience, and related topics. Each edition is a limited physical print mailed directly to subscribers.
We have made every effort to provide an accurate representation of our products in our online store. Colors or product appearance may differ slightly from how they appear on your screen due to printing variation and device display settings. We do not warrant that the appearance or quality of any edition will meet your exact expectations as depicted online.
All product descriptions are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product or subscription tier at any time.
SECTION 3 - ORDERS AND SUBSCRIPTIONS When you subscribe, you are entering into a recurring purchase agreement. Your subscription will automatically renew at your selected billing interval (monthly, every 3 months, or every 6 months) until you cancel. You will be charged at the start of each billing cycle.
Tempest & the Rabbit reserves the right to accept or decline your order for any reason at its discretion. We must receive and process your payment before your subscription is accepted.
Please review your subscription selection carefully before submitting. Cancellations take effect at the end of your current billing cycle. We are unable to issue refunds for billing cycles already in progress or for issues that have already shipped. Please refer to our Refund & Cancellation Policy for full details.

SECTION 4 - PRICES AND BILLING Subscription prices are as follows at time of publication: $12/month (monthly), $33/3 months ($11/mo), $60/6 months ($10/mo). Prices are subject to change. Any price changes will be communicated to active subscribers in advance and will take effect at the start of the next billing cycle.
Your subscription will be automatically charged to your payment method on file at the start of each billing cycle. It is your responsibility to ensure your payment information is current and accurate. Failed payments may result in suspension or cancellation of your subscription.
You agree to provide current, complete and accurate payment and account information for all purchases. You agree to promptly update your account information, including email address and payment details, so that we can complete your transactions and contact you as needed.
SECTION 5 - SHIPPING AND DELIVERY The Curiouser ships to US addresses only at this time. Issues are shipped by the 7th of each month. To receive a given month's edition, you must subscribe before the cutoff date listed on the subscription page.
We are not liable for shipping delays caused by carriers or events outside our control. Once we transfer your booklet to the carrier, risk of loss passes to you. If your issue is lost or damaged in transit, please contact us via the form on the contact page within 7 days of your expected delivery date and we will work to make it right.
SECTION 6 - INTELLECTUAL PROPERTY All content produced and distributed by Tempest & the Rabbit — including but not limited to the written letters, editorial design, crosswords, playlists, glossaries, and all associated branding — is owned by Tempest & the Rabbit and protected by U.S. copyright and intellectual property laws.
Your subscription grants you a personal, non-commercial license to read and enjoy each edition. You may not reproduce, distribute, scan, photograph, or otherwise reproduce any portion of our publications without prior written consent. Sharing or redistributing our content without permission is a violation of these Terms.
Tempest & the Rabbit's name, logo, and brand elements are trademarks of Tempest & the Rabbit. You must not use such trademarks without prior written permission.
SECTION 7 - OPTIONAL TOOLS You may be provided with access to customer tools offered by third parties as part of the Services, including subscription management tools, which we neither monitor nor have any control nor input over beyond their integration with our store.
You acknowledge and agree that we provide access to such tools "as is" and "as available" without any warranties, representations or conditions of any kind. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.
SECTION 8 - THIRD-PARTY LINKS The Services may contain hyperlinks to third-party websites. We are not responsible for the content or accuracy of any third-party materials or websites. If you leave our Services to access third-party sites, you do so at your own risk. Complaints or questions regarding third-party products and services should be directed to the third-party.
SECTION 9 - RELATIONSHIP WITH SHOPIFY Tempest & the Rabbit is powered by Shopify, which enables us to provide the Services to you. Any sales and purchases you make in our store are made directly with Tempest & the Rabbit. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Tempest & the Rabbit. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Tempest & the Rabbit.
SECTION 10 - PRIVACY POLICY All personal information we collect through the Services is subject to our Privacy Policy. By using the Services, you acknowledge that you have read our privacy policy. Information you submit will be transmitted to and shared with Shopify as well as third parties in order to provide services to you.
SECTION 11 - FEEDBACK If you submit any ideas, suggestions, feedback, reviews, or other content, you grant us a perpetual, worldwide, royalty-free license to use, reproduce, modify, publish, and distribute such content for any purpose, including to operate and promote the Services.
You represent and warrant that you own or have all necessary rights to any feedback you submit, and that your feedback will not violate any third-party rights. We are under no obligation to maintain your feedback in confidence, pay compensation for it, or respond to it.
SECTION 12 - ERRORS, INACCURACIES AND OMISSIONS Occasionally there may be information on our Services that contains typographical errors, inaccuracies or omissions relating to product descriptions, pricing, shipping charges, or availability. We reserve the right to correct any errors or omissions and to change or update information at any time without prior notice.

We may limit by technical measures whether and how any Agent accesses our Services.
SECTION 15 - TERMINATION We may terminate this agreement or your access to the Services at any time without notice, and you will remain liable for all amounts due up to and including the date of termination. Sections covering Intellectual Property, Feedback, Disclaimer of Warranties, Limitation of Liability, Indemnification, and Governing Law will survive any termination.
SECTION 16 - DISCLAIMER OF WARRANTIES THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED 'AS IS' AND 'AS AVAILABLE' WITHOUT ANY REPRESENTATION, WARRANTIES OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE.
SECTION 17 - LIMITATION OF LIABILITY TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO CASE SHALL TEMPEST & THE RABBIT, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING LOST PROFITS, LOST REVENUE, LOSS OF DATA, OR ANY SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY OR OTHERWISE, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCTS PROCURED USING THE SERVICES.

SECTION 22 - GOVERNING LAW These Terms of Service shall be governed by and construed in accordance with the laws of the state of Virginia, where Tempest & the Rabbit is headquartered. You and Tempest & the Rabbit consent to venue and personal jurisdiction in such courts.

SECTION 24 - CHANGES TO TERMS OF SERVICE We reserve the right to update or replace any part of these Terms of Service at any time by posting changes to our website. We will notify you of any material changes, and such changes will be effective on the date specified in the notice. Your continued use of the Services following any changes constitutes acceptance of those changes.
